| TERMS AND CONDITIONS FOR
LES CHEVREFEUILLES (“Agreement”) |

Party Leader’s Responsibilities
The person (“Party Leader”) making the reservation
must be over 18 years of age and be authorised by all
other persons in the party to enter into this Agreement,
(“Party Leader”). The Party Leader shall assume
full responsibility for all persons in the party, their
actions and their safety, during your stay at Les Cheverefeuilles,
Malabat 32730, “the Property”.
Responsibilities of the Owners
During your reserved stay at the Property the Owners will
ensure that the Property is cleaned, equipment checked
and the grounds tidied prior to your arrival. All beds
and linen will be prepared for the numbers requested in
your party. Subject to the terms of this Agreement you
will have full and unfettered use of the house and its
grounds during your stay without interference from the
Owner or Gascony Care, (the Owner’s agent). The
Owners or its agent will be available to answer any reasonable
questions or issues you may have during your stay and
will make all reasonable efforts to correct any problems
you may encounter.
Booking Deposit
A non refundable Booking Deposit payable to Procure Consultancy
Limited (the “Owners”), will hold your booking
until full payment for the week(s) reserved is received
by the Owners, within the terms of this Agreement.
Full Payment
Full payment for the week(s) you have reserved, must received
no later than 8 weeks before your start date of your holiday
in the Property. If you fail to pay the total amount required,
in full by the date detailed in the covering letter that
will be sent to you, then the non refundable Booking Deposit
will not be returned and you will lose your booking.
Indemnity
You must indemnify the Owners and hold them harmless against
any and all action and/or costs awarded against them as
a result of your or any member of your party’s actions
during your stay in the Property. We strongly recommend
you obtain adequate insurance cover.
Arrival and Departure
Handovers normally occur on each Saturday. Therefore in
order for us to prepare the Property prior to your arrival
you agree and acknowledge that your party will arrive
at the Property no earlier than 12 pm on the first Saturday
of your holiday and acknowledge that you will all vacate
by no later than 9 am on the Saturday following the last
day of your assigned departure date. Please ensure Gascony
Care is aware of your estimated arrival and departure
times so that the handover of the keys can take place
at a time to everyone’s mutual benefit. If you need
to leave early, we do have provision with an English speaking
neighbour to take the keys if necessary.
Security Deposit
A refundable security deposit is required from you and
must be paid with the balance of the monies for your reservation
as detailed above in Full Payment. Hopefully there will
not have been any mishaps, but you must bring to the attention
of the owner’s agent immediately any damage, breakages
or any other problem caused by you or your party occur
during your stay in the Property. You acknowledge and
agree that the costs incurred by the Owner to correct
such issue(s) will be deducted from your security deposit.
Your security deposit will be returned to you at the address
given, within two weeks of your departure from Malabat.
The full amount will be repaid unless the Owners agent
report an issue with the property and its contents caused
during your stay. To avoid unnecessary delay in returning
your deposit we would ask that you bring to the attention
of our agent any breakages, damage, etc, caused by you
or your party prior to your departure.
No Smoking
In order to cater for families and all other parties wishing
to enjoy the clean atmosphere of our area we insist that
the house remains a no smoking zone and ask that you respect
this condition.
Confirmation
You must confirm that you are over 18 years of age and
by signing the reservation document sent to you, you acknowledge
that you have read and understood all the terms contained
therein and agree to be bound by them.
FURTHER CONDITIONS AND INFORMATION
1. The Law
We pride ourselves in that we adhere to the safety standards
required by the laws of France. We do want you to enjoy
yourselves but respectfully ask that you and your party
comply with the laws of France and respect the privacy
and rights of your neighbours whilst in Malabat.
2. Safety Equipment
We have provided fire extinguishers, a fire blanket,
and smoke and CO2 detectors. You should familiarise
yourself with all exists and the correct use of the
emergency equipment on site. Commercial First Aid kits
are also available on site case of accidents. As the
leader of your party you have the responsibility for
everyone in your party, their safety and to ensure that
you all take all reasonable precautions to avoid accidents
during your stay. A telephone is in the house in case
the need arises to call for help. A Centre de Secours
is located in Villecomtal. We strongly recommend that
you obtain adequate insurance cover. We hope it goes
without saying but the safety equipment we have provided
is there for you safety and must never be tampered with
unless you require them for their intended purpose.
Incorrect or mischievous use of safety equipment could
put your own or other’s lives at risk.
3. Potential Hazards
Please be safe during your stay and in particular pay
special note to the following. The staircase from the
dinning area has open treads and polished wooden surfaces.
Security gates to secure young children from access
to the stairs from the first floor are provided for
you to install if required. All surfaces on the ground
floor are tiled, this helps to keep the property is
cool during the summer but is very hard if someone should
fall. We have placed loose rugs on the floors for your
comfort in each of the rooms. Electrical sockets in
France are always live and electrical equipment is not
always earthed. The open fireplace in the lounge must
not be used by children or used to burn rubbish. It
must only be used with the materials provided and only
if the weather is such that the internal temperature
is uncomfortable. All fire, candles, electric or naked
flame heaters must never be left unattended and always
be supervised by an adult. Gas bottles maybe exchanged/purchased
locally in the village.
4. Swimming Pool
Unfortunately each year seems to claim victims of accidents
by visitors to holiday homes in France, especially those
using swimming pools. Therefore for 2004 new swimming
pool regulations have been introduced, which means fencing
will surround the swimming pool at the Property. We
must therefore point out again that as the leader you
must ensure that your party is supervised at all times.
Running inside the pool area and diving is hazardous
and should not be permitted.
5. Garden
We have a 2Ha garden which we hope will provides hours
of fun and adventure, on the southern boundary is a
stream that can be reached via a steep bank. The bank
is a rough wooded area and often slippery if it is wet.
There are many mature trees and we have recently discovered
a well in the garden which will be secured.
6. Pets
We do welcome domestic animals, but only small cats
or dogs. Please note that the car journey would be very
arduous for any animal during the summer heat and they
could be very distressed by the experience. You will
be responsible for them at all times, for any damage,
injury or distress caused to or by them. Please ensure
that your dogs are kept on a lead whilst walking in
the countryside and in your control whilst outside.
In France many dog owners leave their animals to roam,
this may also present a risk to your pet. The property
is enclosed, but on some sides by only trees or hedge
rows. Therefore this will not prevent your animals from
being able to exit the property. We cannot accept any
responsibility for any injury to or loss of your pets
during your stay in France. Please ensure you are fully
insured and appraised of the travel conditions and legal
requirements for your pets during your out bound and
very importantly on the return journey. All too often
owners have found their pets being taken into quarantine
by the Authorities because the paper work was not completed
properly prior to the return leg. We do not have pets
ourselves and therefore are not in a position to advise
you. You must seek professional advice before you decide
to bring your pet to France. Our advice is to find a
quality kennel or cattery locally at home and enjoy
your holiday with peace of mind.
7. Utilities
7.1 If required the house is heated
via gas fired central heating and open fires. The gas
is fed from a tank in the garden and is refilled automatically
by arrangement with Primagaz. The cooker is electric.
The water is heated by gas and/or electric. The waste
water drains into a tank on site and therefore only
the chemicals provided should only be used for the,
toilets, washing machine and dish washer in order to
avoid damaging the chemical balance in the tank. Whilst
there is a well on the property with a working hand
pump, we are connected to the mains water supply.
7.2 A telephone is provided for; emergencies,
reporting faults, incoming calls from home or to make
local calls. If necessary your family or friends can
contact you at the house during your stay on 00 33 5
62 64 85 09. Please do not abuse this facility which
we feel is essential for your safety and convenience,
however should any telephone charges above those described
be incurred during your stay, then they will be deducted
from your security deposit or if already repaid, then
an invoice will be raised for full repayment.
7.3 Emergencies: Dial 112 or 18 for Fire (le
feu or Pompiers), 15 for Ambulance or 17 for Police.
For all other emergencies or maintenance issues please
call Gascony Care on 05 62 99 48 02 or in there absence
the Owners on +44 1672 519344.
8. Banking and Money
The French banking system is made up of contrasts. You
will discover that it is very difficult to locate a
Bureau de Change outside of major cities like Paris,
and that banks will only change money for you if you
bank with them LOCALLY. However the local Bank of Credit
Agricolle in the nearby town of Rasbestens de Bigorre
contains an ATM that subject to adequate funds will
dispense Euros to you, if you have a UK credit or debit
card that requires a pin number. Many people no longer
carry large amounts of cash to see them through their
holiday, preferring to withdraw money from an ATM locally.
9. Welcome Pack
A welcome pack which will consist of a few basic food
items can be purchased for you ready to be used when
you arrive. Please let our agent know your requirements
on 00 33 05 62 99 48 02 and please pay them locally
in € on arrival. You understand that we cannot
cater for specific dietary or medical needs you or your
party may have.
10. Final Notes
It is not normally necessary to wash any bed linen or
the towels provided as this will be done by our agents.
Please do ensure the crockery and cutlery you have used
is washed and dried prior to your departure and any
equipment used is returned to its stowed positions.
We do hope your stay will be most relaxing, enjoyable
and only ask that you leave the property as you found
it.
